Information prior to the contractual process

The present website www.analogica-sunglasses.com is the property of the company Quidcomm Global Communication S.L., a trading company constituted in accordance with Spanish legislation, provided with Tax Identification Code B-87239018 and registered in the Companies Register of Madrid, Volume 33.416, Folio 131, Section 8, Page m601521, 1st Inscription, and with registered office at C/ Lope de Vega 4, 28223, Pozuelo de Alarcón, Madrid.

The General Terms and Conditions of Contract regulate the distance selling relationship between Quidcomm Global Communication S. L and the user or client, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Contracting Conditions, Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

Quidcomm Global Communication S.L. reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. Said modifications may be made, through its websites, by any legally admissible means and shall be binding during the time they are published on the website and until they are validly modified by subsequent modifications. However, Quidcomm Global Communication S.L. reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems appropriate, announcing them in due time and form.

The purpose of the website is to offer and advertise the sale of all types of sunglasses & fashion, with designs of ANALØGICA brand.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.

As a user or customer, you expressly declare that you know, understand and accept the conditions of use and these general terms and conditions. Likewise, you declare that you are of legal age and have the necessary legal capacity to access Quidcomm Global Communication S.Ly’s websites and to contract through them.

To purchase our products, you can go to the corresponding section of our online shop.

Once the purchase process has been completed, the customer will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid email address. If you do not receive the confirmation within 24 hours of completing the order, please contact Quidcomm Global Communication S.L. on the customer service telephone number or by e-mail: info@analogica-sunglasses.com.

Upon receipt of the product at the delivery address provided, the customer will receive an invoice or a copy of the order.

Customers consent to receive invitations to review their orders

Offer and validity 

In the case of a product on offer, the offer price and its validity will always be indicated together with its essential characteristics.

In compliance with current regulations, Quidcomm Global Communication S.L. offers information on all the articles on sale, their characteristics and prices. However, Quidcomm Global Communication S.L. reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the same. In this way, the products offered at any given time on the website will be governed by the General Contracting Conditions in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products.

Essential characteristics of the products

The products offered in our online shop, incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer. The colour of the product, observable in the photograph is not binding. It is identified in the characteristics.

Clothing Policy

Our clothing products are crafted specifically for you upon placing an order, hence the slight delay in delivery. Opting for on-demand production over bulk manufacturing allows us to minimize overproduction, and we appreciate your thoughtful purchasing choices.

They will be delivered separately.

Prices

All products indicate the selling price in Euros or Dollars and include Value Added Tax (VAT).

If any other tax is applicable, this will be indicated.

The corresponding VAT will be applied to the products marketed on the Website in each case:

The VAT of TWENTY-ONE PERCENT (21%) will be applied to Sunglasses as a general tax rate.

A VAT of TEN PERCENT (10%) will be applied to Replacement Glasses, as determined in article 91 of Law 37/1992, of December 28, on Value Added Tax.

Shipping costs

Your purchased products will be delivered to the physical address specified by you.

– ANALØGICA is not responsible for delays once the order is handed over to the postal service.

– Products may be received in different shipments.

– Shipping costs include transport, insurance to the address indicated by the buyer at the time of ordering. The customer will be responsible for any customs fees.

– We offer free shipping for all orders within EU. For orders outside Europe, the minimum purchase requirement for free shipping is 99€.

Delivery of the order

Once the Shipping Confirmation has been sent, the Product will be delivered to the address indicated by the user when placing the Order within approximately one to fourteen (1-14) working days from the time the products leave the Quidcomm Global Communication S.L. warehouse, depending on your location. Please, refer to the “Shipping costs” section for further information. For ‘pre-order’ products the ‘pre-order date’ is when we expect them to be ready for shipping. Payment is collected upfront for pre-orders.

Quidcomm Global Communication S.L. assumes no responsibility when the delivery of the Product does not take place as a result of the data provided by the User being false, inaccurate or incomplete or when the delivery cannot take place for reasons beyond the control of the delivery company assigned for this purpose, such as the absence of the User or the retention of the Product in Customs.

Delivery times are approximate, although Quidcomm Global Communication S.L. tries to comply with them.

Forms of payment and execution of the order

The customer may pay the amount of his order by choosing any of the following methods of payment. During the purchase process you must indicate your choice:

– Stripe (VISA, VISA or MASTERCARD CREDIT or DEBIT card).

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All the information you transmit to us travels encrypted through the network.

Likewise, your credit card details are entered directly on the bank’s website, at the bank’s POS (Point of Sale Terminal) and are not entered or registered on any Quidcomm Global Communication S.L. server.

When paying by VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiry date, and a Validation Code that coincides with the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

This payment method is only valid on the website.

If the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries shall be made as soon as possible in the accounts of the supplier and the cardholder.

However, if the purchase has actually been made by the cardholder and the demand for a refund is not the result of exercising the right of withdrawal or termination and, therefore, the cardholder has unduly demanded the cancellation of the corresponding charge, the cardholder shall be liable to Quidcomm Global Communication S.L. for compensation for the damages caused as a result of such cancellation.

The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. Paypal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

Quidcomm Global Communication S.L. undertakes to deliver the order within a maximum of 30 days from the day after the order is placed.

The availability of the products offered by Quidcomm Global Communication S.L. may vary depending on customer demand. Although Quidcomm Global Communication S.L. regularly updates its stock, the product requested by the customer may be out of stock at that time. In the event of non-execution due to unavailability, Quidcomm Global Communication S.L. will notify the customer by e-mail as soon as it becomes aware of this situation. The period of this communication shall in no case exceed a maximum period of 30 days. Quidcomm Global Communication S.L. will be able to give the customer the double option of: supplying the customer with a product of similar characteristics or of superior quality without an increase in price, or, except for reasons justified and demonstrable by Quidcomm Global Communication S.L., within the same period, paying the sums paid for the cancelled order. In the event that Quidcomm Global Communication S.L. does not make this payment within the aforementioned period, the purchaser may claim payment of double the sum due, without prejudice to his right to compensation.

Right of withdrawal, returns and complaints

The purchaser will have a minimum period of fourteen calendar days to withdraw, from the day on which the customer receives the product, without penalty and without stating the reasons.

The exercise of the right of withdrawal must be notified by e-mail to info@analogica-sunglasses.com.

According to the provisions of article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, supplies of services or goods made according to the specifications of the consumer or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal.

The customer will be responsible for the direct cost of returning the product to Quidcomm Global Communication S.L., whether they return the order by mail or by post. whether they return the entire order or decides to return only some of the products in the order.

To formalise the return, you must contact ANALØGICA at www.analogica-sunglasses.com/contact, sending the completed withdrawal form which is attached to these Terms and Conditions as ANNEX 1. Upon receipt of such communication, ANALØGICA will indicate how to send the order to its offices or warehouses.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. We therefore ask you to make sure that the package is properly protected and sealed to avoid any problems during transport. Once received, we will check its condition. As soon as we check that the item/s, as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid for the products purchased. Under no circumstances will the amount paid for “Shipping” be refunded.

Appendix 1

Once we receive the product and check that it is in good condition, the payment will be refunded within 30 working days.

In case of unjustified delay on the part of Quidcomm Global Communication S.L. in respect of the refund of the sums paid, the customer may claim double the sums paid, without prejudice to the right to be compensated for damages suffered in excess of this amount.

– Return of the defective product.

In the event that the product is not in good condition and the causes attributable to this are not the result of the customer, the customer shall have the right to return the product, informing Quidcomm Global Communication S.L. of the reason for return by any of the means provided in these terms and conditions of contract, and at no cost to the customer. This return due to a defect or poor condition of the product shall not be considered a right of withdrawal.

Quidcomm Global Communication S.L. undertakes to assume the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

Jurisdiction

Likewise, Quidcomm Global Communication S.L. reserves the right to bring any civil or criminal action it deems appropriate for the improper use of its website and content or for breach of these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or go to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. Quidcomm Global Communication S.L. is domiciled in MADRID, Spain.

All those products that are purchased in the “Offers” section with a discount on their original price will be subject to a special exchange and return policy.

All products purchased with discount codes, with a catalogue discount on their original price, are products with a discount on their original price.
